Permitted Payments (What Tenants Can Pay) Under Tenant Fees Act 2019


Tenancy Agreements subject to the Tenant Fees Act 2019

Permitted Payments (What Tenants Can Pay):

Princess Park Estates, and other agents/landlords, can only charge the following: 

  • Rent: Regular, agreed payments.
  • Refundable Tenancy Deposit: Capped at five weeks’ rent (for annual rent under £50,000) or six weeks’ rent (for annual rent of £50,000 or more).
  • Refundable Holding Deposit: To reserve a property, capped at one week's rent.
  • Default Fees: Fees for late rent payments (over 14 days overdue, capped at 3% above the Bank of England base rate) or lost keys/security devices.
  • Utilities & Services: Payments for utilities, council tax, TV licence, and communication services if required by the tenancy agreement

 

Banned Fees (What Tenants Cannot Be Charged):

Princess Park Estates  cannot charge tenants for:

  • Property viewings or admin/setup fees.
  • Referencing, credit checks, or inventory checks.
  • Guarantor fees.
  • Professional cleaning at the end of the tenancy.

 

Penalties for Non-Compliance:

Breaching the Tenant Fees Act can have serious consequences for landlords and agents: 

  • Fines: An initial fine of up to £5,000 for a first offence.
  • Criminal Offence: A subsequent breach within five years is a criminal offence, which can lead to an unlimited fine or a banning order.
